TERMS OF SERVICE

• Contact of Studio

  • Business Hours : 6:00AM-10:00PM, Sunday-Saturday.​

  • If Studio is contacted outside of the listed business hours, Studio cannot promise immediate response until the start of the next business day.

• Hiring Period

  • Studio requires 48 hours notice period before the start of a Project to prepare and plan for the Project that Studio is being hired for by Client.​

• Cancellation Period

  • Studio requires 24 hours notice before the start of a Project for the Client to cancel a listed day of hire requiring the services of Studio.​

• Pricing and Rates

  • Listed in the "Rates" tab on abyssalaudiostudio.com, Client agrees to the listed pricing and rates.​

  • If a different price is negotiated and contracted in writing, then Client agrees to that updated rate.

• Payment

  • Client is required to provide payment to Studio at the start of the daily Project that Studio is hired for.​

  • Payment is due in the form of cash. Credit/Debit cards will not be accepted. Checks will only be accepted if negotiated within 24 hours of Project start.

SERVICES PROVIDED BY STUDIO

• Location Sound​

  • Studio is able to provide professional location sound recording and mixing for hired Projects.​

• Post Production Sound Effects

  • Studio is able to provide sound effects editing for hired post production Projects.​

  • Sound files used in sound effects editing are either custom made for the specific project or purchased with a license from an external source.

• Post Production Foley

  • Studio is able to provide foley effects editing for​ hired post production Projects.

  • Foley effects are produced with Studio's own studio environment.

• Sound File Transfer

  • For recording and mixing files from ​location sound Projects, Studio will provide a SD Card with all files to Client at the end of the daily Project.

  • For sound effects and foley files from post production Projects, Client can either select to have the files delivered via a physical drive or have the files shared via an online transfer site.

    • For delivery of a physical drive, Client must be within a 4 hour drive of Studio.​

CONDITIONS OF HIRE

• Studio Responsibilities​​

  • Studio is a recording and mixing company that provides location sound and post production sound effects and foley effects for hiring companies. For more information, please see section Services Provided By Studio.​

  • Studio agrees to arrive at Project's determined location at a determined time, provided by Client at least 24 hours before Project start.

  • Studio agrees to give Client the audio files on a SD Card at the end of the daily project time period. If multiple days are required, then a SD Card will be provided each day that Studio is hired by Client. After SD Card has been given to Client, Studio has no responsibility for the audio files afterwards.

  • Studio is no responsible for gear or equipment that does not belong to Studio.

  • Studio is no responsible for acquiring legal permission forms signed for recording individuals or locations.

• Client Responsibilities

  • Client agrees to pay the listed price for the selected option upon the start of each day Studio is required for Project.​

  • Client agrees to acquire legal permission forms signed for all individuals and locations being recorded.

  • Client is responsible for the other members and individuals on site of the Project, regarding Studio equipment. If another member of Client's project or an outside individual that is on the Project site, touches or moves equipment belonging to Studio without written consent from Studio, Client takes full responsibility of said actions and possible damages that could occur.

  • Client cannot press charges, and Studio is exempt from charges, should copyright claims or other legal actions be taken against Client for negligence of approval to record audio of individuals or locations.

CONTRACT OF AGREEMENT

• Studio Agreement

  • Studio agrees to all Studio Responsibilities listed within Conditions of Hire upon agreement to work for Client.​

• Client Agreement

  • Client agrees to all Client Responsibilities listed within Conditions of Hire upon arrival of Studio at determined time and location of Project.​
